Nurse Files Federal Lawsuit After Arrest for Giving Inmate Benadryl Claims Unjust Prosecution in Clayton County Jail Case

In May 2023, Clayton County Jail nurse Jessica Marie Cotney was arrested and charged with furnishing prohibited items to inmates and obstruction after administering Benadryl to an inmate, a claim she asserts was legal under jail protocols. The felony charges against Cotney were dropped in March 2024, but she has since filed a federal lawsuit against investigator Albert Davis, alleging her rights were violated and that the prosecution was baseless. Cotney, who is no longer employed at the jail, is seeking a trial and unspecified damages, citing emotional distress and reputational harm from the incident.
